नयी दिल्ली, 15 अप्रैल (भाषा) कार्यकर्ता नदीम खान ने मंगलवार को दिल्ली उच्च न्यायालय में याचिका दायर कर अनुरोध किया कि शत्रुता को बढ़ावा देने के कथित मामले में राष्ट्रीय राजधानी से बाहर उनकी यात्रा पर लगाई गई शर्त में ढील दी जाए।


खान ने वह शर्त हटाने की मांग की जो उन्हें सक्षम अदालत की अनुमति के बिना राष्ट्रीय राजधानी छोड़ने से रोकती है। उच्च न्यायालय ने पुलिस द्वारा किसी भी दंडात्मक कार्रवाई के खिलाफ उन्हें संरक्षण प्रदान करते हुए उनपर यह शर्त लगाई थी।


नई याचिका न्यायमूर्ति रविंदर डुडेजा के समक्ष सूचीबद्ध की गई जिन्होंने इसे न्यायमूर्ति जसमीत सिंह की अदालत को स्थानांतरित कर दिया था।


न्यायमूर्ति जसमीत सिंह की अदालत ने 11 दिसंबर, 2024 को यह शर्त लगाई थी। याचिका पर 21 अप्रैल को सुनवाई होगी।


संक्षिप्त सुनवाई के दौरान खान के वकील ने कहा कि वह शर्त में परिवर्तन की मांग कर रहे हैं क्योंकि वह गैर सरकारी संगठन ‘एसोसिएशन फॉर प्रोटेक्शन ऑफ सिविल राइट्स’ से जुड़े हैं और उन्हें दिल्ली से बाहर यात्रा करना आवश्यक है।


सोशल मीडिया पर एक वीडियो आने के बाद खान पर दुश्मनी को बढ़ावा देने और आपराधिक साजिश रचने के कथित अपराधों के लिए मामला दर्ज किया गया था।


गैर सरकारी संगठन (एनजीओ) के राष्ट्रीय सचिव खान और उनके संगठन ने उनके खिलाफ प्राथमिकी को रद्द करने की मांग करते हुए उच्च न्यायालय का रुख किया था।


पुलिस ने दावा किया कि कथित वीडियो से शत्रुता पैदा हो सकती है और कभी भी लोगों में हिंसा भड़क सकती है।


पुलिस द्वारा यह सूचित किए जाने के बाद कि वह कार्यकर्ता को सात दिन का लिखित नोटिस दिए बिना गिरफ्तार नहीं करेगी, अदालत ने याचिका का निपटारा कर दिया था।


दूसरी ओर खान ने अदालत को आश्वासन दिया था कि वह 30 नवंबर, 2024 को शाहीन बाग पुलिस थाने में उनके खिलाफ दर्ज प्राथमिकी के अनुसार जांच में सहयोग करना जारी रखेंगे।

His counsel had said the police should not harass the petitioner in the garb of investigation and ensure the probe was concluded expeditiously.


He had argued the police was conducting a roving and fishing inquiry.


The court had orally said while his right to liberty was protected, the agency was entitled to investigate and kept the rights and contentions of the parties open.


Delhi Police claimed Khan, through "targeted dissemination of selective information", sought to create a narrative of a particular community's victimisation by the incumbent government.


In a status report filed in the case, the police said such actions suggest a deliberate attempt to provoke discontent and unrest, amounting to a larger conspiracy for undermining communal harmony and public order. PTI SKV
